Updates on the organization's efforts for implementing contractor liability as part of the 2016 planning and construction regulations (building permit)

Dear Members,

We wish to inform you of another important organizational activity benefitting the interests of IOCEA members.

Recently, the organization has been operating on numerous levels in order to ensure that the subcommittee for the planning administration will push forward the regulation implementing contractor liability as part of the Planning and Building Regulations (Building Permit) 5776-2016. Following considerable efforts by the organization and its legal counsels, the planning administration subcommittee has decided, in a meeting dated 22.07.16, to recommend before the national council to add the following provision, as Section 90a:

“The liability of the applicants submitting the permit request or the building’s skeleton frame planner or the person responsible for the performance of the building’s skeleton frame or the person responsible for inspection of performance, in accordance with this Part, shall not be construed to hold harmless any contractor with regards to the performance of the building in accordance with the permit and with regards to the quality thereof, including liability with regards to full supervision and inspection of the building’s performance, in accordance with any Law”.

The organization finds this decision to be highly significant, and will continue maintaining the interests of its members, as it does regularly.
